DOES A MARRIAGE IN A FOREIGN COUNTRY CANCEL MY MARRIAGE IN UGANDA?
Mukebe worked in 'Bulaya' (outside countries) for 13 years. When Juliet went to do 'kyeyo' (work) two years ago, she met Mukebe while she was out shopping, and they immediately hit it off. Last year, they returned to Uganda for Christmas and he went to her parents' home and they had a kwanjula and immediately returned to the UK to continue their 'kyeyo'. However, a strange woman contacted Juliet on social media and demanded that she leaves her husband alone. Upon asking Mukebe about it, he boldly told her that this was his 'sugar' mummy who was going to make him a UK citizen and they had held a small wedding in the UK in February this year. Juliet wants to know if she can get this marriage cancelled.
CAN I CANCEL A FOREIGN WEDDING?
YES YOU CAN!.
Sometimes, when people are buying land, we say they have bought 'air'to mean that even if they have paid cash for that land, they do not have any rights over it. Even marriage can be like that. If you go and have a big wedding but fail to do what the law asks you to do, then you will have just put on a show but will not be married. For example, if you marry someone who is already married, then in some cases, the law will take it that your marriage is 'fake' and did not happen. (this is what we mean when we say it is nullity).
Some types of marriages allow you to marry again even when you are still married (they are called polygamous marriages) such as our customary marriages. however, you cannot marry someone else in a monogamous ('one man one woman') marriage if you are also in a polygamous marriage.
So, since Juliet got married in Uganda using a legally recognised marriage, then Mukebe cannot be allowed to marry someone else except by entering into a customary marriage unless he divorces Juliet first. This is because countries like the UK allow marriages from other countries like Uganda and they will not allow 'already married' people to start different marriages.
So, if we go by this, then Juliet's marriage with Mukebe is recognized by the law, but that other marriage is 'fake'.
