IS IT LEGAL FOR SOME ROADS TO BE PAID FOR BEFORE YOU CAN DRIVE ON THEM?
Simon Okurut bought a new hero bicycle and his son decided to invite him to Kampala so that he could enjoy some Kampala life when he came to pick up his new hero bicycle. While testing it out, he came across a road that had a big sign posts showing that bicycles, motorcycles and pedestrians, were not allowed. This really disturbed him and so he asked a gonja seller about it. The gonja seller told him it was called the express highway and that the Government of Uganda and the Government of China signed an agreement where the Chinese government loaned Uganda a lot of money, to construct it and so users will even have to pay some 'ka-money' to use it. Simon Okurut just does not understand this. Afterall, he has never failed to pay any tax they asked from him so how come they won't let him use a road that is in his country?
IS THIS LEGAL?
In 2018, the Ugandan Parliament passed a law called the Uganda Roads Act. This law provides for a number of things like control of vehicle loads, execution of road works, road safety and so on. More importantly though this law provides for what is known as Toll roads.
Simply put, a toll road is where fees (money) are charged and collected from vehicles using that road. Which means that in order to use the road, you have to first pay. The Kampala- Entebbe Expressway is an example of such a toll road. At the moment however, vehicles are using it free of charge but a fee will soon be put for its use.
WHY SHOULD I PAY?
Under the Uganda Roads Act, it is stated that a charge shall be levied on a vehicle using a toll road for the purpose of recovering the cost of construction, operation, maintenance and rehabilitation of the road. This therefore means that the reason why you will have to pay to access such a road is to help the government to recover the cost of construction to payback the loan that it got to build the road.
IS EVERYONE SUPPOSED TO PAY?
Yes! Everyone should pay for the use of the road, except for emergency vehicles such as the fire brigade and ambulances. The Presidential convoy is also exempted from paying the toll fee. However, the Minister of Works may also by statutory instrument and after consultations exempt a vehicle or classes of motor vehicles from the payment of a road toll.
