More than 100 House Republicans sign on to Texas suit filed in Supreme Court

More than 100 House Republicans threw their support behind the lawsuit the state of Texas filed with the Supreme Court against a handful of battleground states that went for President-elect Joe Biden.

The 106 Republican lawmakers signed on to a brief with the Supreme Court in support of the case on Thursday, days after Texas Attorney General Ken Paxton filed the lawsuit alleging that the commonwealth of Pennsylvania and the states of Georgia, Michigan, and Wisconsin unconstitutionally changed how their states vote ahead of the 2020 election.

House Minority Whip Steve Scalise signed on, while Minority Leader Kevin McCarthy and Conference Chair Liz Cheney did not.

"Due in large part to those usurpations, the election of 2020 has been riddled with an unprecedented number of serious allegations of fraud and irregularities," it reads.

Rep. Mike Johnson, a Republican from Louisiana, circulated an email to other GOP members urging them to support the amicus brief, according to CBS News.

The suit, which said the election “suffered from significant and unconstitutional irregularities,” also claimed there were “intrastate differences” in how certain voters were treated and that there was an unconstitutional “relaxation” of ballot-integrity laws. The president himself has also signed on to the case and has asked Texas Sen. Ted Cruz to argue the case on his behalf, and the senator agreed.

In a separate brief filed to the Supreme Court on Thursday, Pennsylvania Attorney General Josh Shapiro wrote that Paxton's suit was the latest in a series of "frivolous lawsuits aimed at disenfranchising large swaths of voters and undermining the legitimacy of the election."

More than a dozen other state attorneys general have signed on to the lawsuit, while those from Michigan, Pennsylvania, and Wisconsin issued a joint statement on Tuesday, saying, “These insignificant attempts to disregard the will of the people in our three states mislead the public and tear at the fabric of our Constitution. The people in our states voted. Their votes were counted — in some cases multiple times. And the results have been certified."

"It’s well past time for the President and our fellow states and elected officials to stop misleading the public about this year’s election and to acknowledge that the results certified in our states reflect the decisions made by the voters in a free, fair, and secure election," it continued.

Paxton's lawsuit, which has been deemed "insane" by some legal scholars, echoed claims made in similar suits filed in various courts throughout the country since the conclusion of the election. Some of those lawsuits came from the Trump campaign, and others have come from adjacent but separate entities. To date, the suits have been overwhelmingly unsuccessful, but the latest tactic has been to try to convince states to appoint pro-Trump electors.

Despite the claims, most election officials and the Department of Justice have found no proof to support allegations of widespread fraud on a scale large enough to overturn the election results.
