DOES THE LAW ALLOW A HOSPITAL TO HARVEST ORGANS OF THE DEAD?

Mabirizi was told that one of his kidneys was failing and he might have to plan for a transplant if he intends to carry on with all his regular activities. When his family members were tested, they found that his nephew Sajjabi was the most compatible. Unfortunately, Sajjabi fell from his office building a week later and did not wake up. Mabirizi saw this as an opportunity to save his own life and immediately rushed to the hospital to demand for the kidney. The question is, is the law allowed to remove such an organ from a person who has died or is about to die.

WHAT DOES THE LAW SAY?

Unfortunately, there is no Ugandan law on how organs of a deceased person should be handled. This means that we can only refer to the international laws that Uganda follows. Under these guidelines (World Health Organisation's Guiding Principles on Human Cell, Tissue and Organ Transplants), only allows a living person to give away their body organs. This must also be carried out while they are alive therefore no person can write a will giving his/her organs to another person. In fact, these organs should be donated without any monetary payment or other reward of monetary value.

However, there is a new law being prepared called the Uganda Human Organ Donation and Tissue Transplant Bill 2020 to regulate on the donation, trade of human organs, cells, and tissue transplant in the country for safety and security of Ugandans.
