IS IT LEGAL FOR KCCA OR POLICE TO TAKE AWAY THE GOODS I'M SELLING?
First it is not clearly stated in law whether KCCA has the right to take away your goods when you are selling them. However, the law says that it is the role of KCCA to prohibit, restrict, regulate, or license where the sale of goods is to be done. Trading or carrying out any commercial activity in the city must be authorized by KCCA and carried out in a designated area.

There are areas where selling of goods is not allowed (such as streets) so KCCA does not issue any permits for street vending. If a person is found selling on such streets, or it is found that you are not observing the authority's directives on how to carry out trade, in carrying out their duty of restricting certain trade habits, your goods may be impounded pending further investigations or to be used as evidence of the offence of illegal trading.

However, if your goods are impounded by KCCA or any other authority, it does not mean you loss ownership of the goods. Therefore, the authority has to issue you a receipt that shows that they have taken your goods or ask you to come collect them after investigations or proceedings are complete.
If the officials start sharing out the goods, it means they have 'stolen' your goods since they do not have powers to share your goods, which is illegal. However, if KCCA asks you to collect your goods that were impounded and you fail, then it has the right to sell them by public auction.
