Desperate Biden revives Trump diplomatic deals to halt border crisis

In the two months since ripping up the diplomatic deals of his predecessor, Joe Biden has faced the first crisis of his own making in his presidency. Donald Trump's safe-third-country deals secured the border not by border policy itself, but rather by ensuring that refugees from the Northern Triangle, now the source of the majority of the migrants seeking our southern border, must apply for asylum from the first safe country they reach.

Biden rescinded these sensible policies, and within the month, Border Patrol reported the highest border crossings in raw numbers for March, with a record number of unaccompanied children endangering their lives by crossing.

Thanks to liberal activists who forced the hand of Bill Clinton in court, no president, Democrat or Republican, has a great option once minors come to the border. Clinton's Flores settlement agreement mandates, among other things, that minors be kept in the least restrictive setting possible, interpreted by liberal courts to mean minor-exclusive facilities operated by the Department of Health and Human Services rather than the facilities operated by Border Patrol. This means presidents must either expel children from the country immediately, rip them from their parents until asylum claims are cleared, or basically open the border to both parents and children by reinstating the chaotic catch and release policy.

Trump tried to reform Flores to allow families to be kept together in Border Patrol facilities, but liberal-leaning courts killed that idea. In the end, the only way he ended his own 2019 border crisis was by disincentivizing migration from the Northern Triangle to the United States. In tandem with the Remain in Mexico policy, those safe-third-country deals were crucial.

Now, Biden, after creating a totally pointless humanitarian crisis, is trying to bring those deals back. At least, that's what you will understand if you listen carefully.

"The objective is to make it more difficult to make the journey and make crossing the borders more difficult,” White House press secretary Jen Psaki said on Monday. “We worked with them to increase law enforcement at the border to deter the travel, which is a treacherous journey.”

Reportedly, the Biden administration has reached deals with Mexico and two of the three Northern Triangle countries, Honduras and Guatemala, to secure their own borders.

Biden realized that the key to solving the immigration crisis given the current legal reality is focusing on suppressing demand of would-be asylum-seekers rather than converting convention centers hundreds of miles from the border into kiddie jails. Color me shocked.

Better late than never. It will prevent the current crisis from becoming as bad as it might have, but it won't solve the problem Biden created there already.
