SUPREME COURT ON LAND ACQUISITION
1. "Article 26 is not among the non derogable rights stated under Article 44, but this does not give powers to Government to compulsorily acquire people's land without prior payment, and such planned government projects do not fall under the exceptions of disasters and emergencies.
2. S.7(1) of the Land Acquisition Act is inconsistent with Article 26 of the Constitution as it allowed government to compulsorily acquire land without prior compensation." - Supreme Court
