No, you cannot. This is because the custody is the right to make decisions on behalf of the child and to physically accommodate the child. If you are still living with your partner, then it means that your partner still has physical custody of the child as well.

Therefore, to ask for custody means that you are taking that custody away from your partner. However, if you separate from your partner and go to another house, then you can ask court for custody since you are not in the same house.
