FLASHBACK : "FORMAL AND INFORMAL JUSTICE SYSTEMS IN UGANDA"

Before colonialism, Ugandan societies had their own systems of Justice. After Uganda became a Protectorate, the British Colonial government then introduced a formal justice system which was borrowed from the laws in other colonies e.g India.

However, this led to constant conflicts between the formal and informal justice system.For example, one famous case said women married traditionally were not lawfully married because since bride price was paid, that was a wife purchase and not a marriage.

As time went on, different customs were eventually integrated into Uganda's legal system. The condition is that such customs should be go against the Constitution.

Its because of this that you have traditional marriages, male circumcision accepted while others like female genital mutilation are not allowed.

In addition to allowing customary laws, another informal justice system is the Resistance Council (now called Local Council) system which was established by the 1987 Resistance Committee Courts (Judicial Powers) Statute. These courts deal with certain matters e.g customary land.
