Federal Judge Rules On Greg Abbott's 'Floating Border Barrier'

A federal judge has ruled against Texas Governor Greg Abbott's attempt to deter illegal immigration with a floating border barrier, siding with the Biden administration's stance.

The 1,000-foot line of buoys, installed across the Rio Grande, was part of Abbott's Operation Lone Star, an initiative aimed at curbing illegal immigration.

Federal District Judge David A. Ezra penned the ruling, stating, "Governor Abbott announced that he was not 'asking for permission' for Operation Lone Star, the anti-immigration program under which Texas constructed the floating barrier." He added, "Unfortunately for Texas, permission is exactly what federal law requires before installing obstructions in the nation’s navigable waters.”

Critics of Abbott's immigration policies, including activist Carolina Canizales, have labeled them as inhumane and unjust. Canizales stated, “The buoys are a symbol of the hate-filled and inhumane policies Gov. Abbott has embraced as he continues to wage war on immigrants seeking to make better lives for themselves, as millions of other immigrants have done for hundreds of years in this country.”

In response to the ruling, Abbott's office announced its intention to appeal. A statement from the governor read, “Today’s court decision merely prolongs President Biden’s willful refusal to acknowledge that Texas is rightfully stepping up to do the job that he should have been doing all along.” The statement further pledged to continue using every strategy to secure the border, including deploying Texas National Guard soldiers, Department of Public Safety troopers, and installing strategic barriers.

The U.S. Department of Justice, which filed the lawsuit against Texas in July, argued that Abbott had not obtained the necessary authorization for the barrier. The lawsuit also posits that the barrier could potentially strain foreign relations with Mexico.

Judge Ezra, in his ruling, suggested that the lawsuit would likely succeed on the grounds that Texas requires a permit from the U.S. Army Corps of Engineers to construct barriers in navigable water. He has ordered the removal of the barriers by September 15.
