Trump’s ‘Liberation Day’ tariffs blocked by federal trade court

A federal court blocked President Trump from slapping sweeping “Liberation Day” tariffs on imports Wednesday, ruling the commander in chief exceeded his authority.

The three-judge panel at the Court of International Trade in Manhattan stated that Congress only has the powers to sort out commerce with other countries despite Trump claiming emergency powers gave him the ability to take action.

The lawsuit was brought by the nonpartisan Liberty Justice Center on behalf of five small businesses that get goods from countries dinged by the White House’s tariff policy.

The plaintiffs argued that Trump can’t use the 1977 International Emergency Economic Powers Act to justify the tariffs, which affected most countries across the globe.

The president imposed the duties in an effort to make up for the United States’ massive, decades-long trade deficits.

He earlier went after Canada, China and Mexico, arguing the threat of steep tariffs was a way to convince the countries to stop the flow of illegal immigrants and dangerous drugs.

The White House insisted that only Congress, and not judges, can determine the “political” question on whether the president is allowed to declare emergency duties.

Trump’s Liberation Day tariffs rattled the global markets last month and sparked fears of a downturn in the economy, though he’s stood by his position.  

The lawsuit involved in Wednesday’s ruling is one of seven court challenges against the president’s tariff policy, along with legal action taken by 13 states and other coalitions of small businesses.
