{UAH} Can Nyombi represent govt if his legal practice license is revoked by the Law Council and courts of law?
Can Attorney General Peter Nyombi represent govt if his legal practice license is revoked by the Law Council and courts of law? Should it happen, though unlikely as it appears, will Nyombi still be relevant as a Govt legal adviser? In fact it is on Hansard Speaker Kadaga stated recently that Parliament takes his opinion with caution!
The answer lies in Article 119 of the Constitution. Clause 2 of that article states that a person shall not be qualified to be appointed AG unless he or she is qualified to practice as an advocate of the High Court and has so practiced or gained the necessary experience for not less than ten years. If the license is revoked, the qualification is also revoked.
However, the AG does not need a license to practice but Kanyeihamba can be stopped from representing govt rebels without a license (how ridiculous is this?). But a rebuke and suspension by the Law Society, if it happens, is a serious indictment of the professional competence of any AG. He can still stay on as AG and legally as the Head of the Bar as required by the law.
The law society can act as a peer review mechanism and if they find him wanting it can at the very least act as a deterrent. There is, however, a faction of NRM lawyers within Uganda Law Society that is causing us a lot of problems. This NRM faction has been used to push illegal stuff down our throats by Museveni several times. For instance, because of this faction, the Lawyers Society is the one that claimed there is a lacuna in the law, so Gen.Aronda can be appointed Minister.
