It appears another local sex tape featuring a well known socialite has hit  the streets!

Forget Pokello's, this time its Tinopona Katsande's, popularly known as "Tintin".

Tin Tin is a radio presenter and also a stage and television actress.

According to Katsande, the "act" was stored in her cellphone, which was stolen sometime in 2012 and reported the theft to police on 20 October the same year.

Issuing a statement on the sex tape, she told her family and friends, the contents of her mobile phone contained sensitive personal messages, photographs and videos, which have now found their way to the public forum.

"It has not been my intent or purpose to have events that take place in my private life, be used to bring you disrepute. All that information was not and is not intended for public consumption. The awkwardness of this and other situations gravely embarrass me and make me feel exposed and violated," Katsande said.

But it has and this where the crux of the matter lies, social media content and invasion of one's privacy, so to say.

Katsande's case is not unique, it is an example of the many people who store personal content in cellphones or laptops but then someone else gains access to their privacy.

The issue is not about the sex tape, there is nothing amazing about that, it is about the power of social media to disseminate any information whether private or public. 

Social media versus invasion of privacy

Social media can be a huge blessing because people can connect with others around the world. However, at the same time, if one is not careful with how they use it, social media can be a huge curse.

Whether it is taking pictures or videos on one's mobile phone or posting anything on Facebook or twitter or other applications, social media can spread it like fire.

This is why individuals have to realise that anything they do or take can leak out and turn them into fools or destroy their reputation.

Katsande pleads with her followers to "kindly accept my sincere apologies for any negative impact my personal actions may cause to you. My intentions were of the best motives and made to be kept between my partner and I."

The lesson is here individuals should keep controversial content away from their personal belongings unless they are sure only they will have access to it.

Sex is one subject, which is to controversial and many people are easily offended, they would not want to network or continue their links.

Now one can see these risks can greatly damage ones presence., which is why Katsande said her lawyers and personal brand management team are working on the issue.

"I once again apologise for the embarrassment or awkwardness this violation of my privacy may cause you and I sincerely implore that this does not happen to any of you unless you have consented to it for what ever reason," she said.

Recently at a Utilising Social Media and New Technology workshop, Admire Mare, a PHD student studying social media said people had to manage or moderate their online content because what they posted would be for used for public consumption.

He said once uploaded that content has an eternal lifespan even if deleted, it could be referenced to in later years.

Mare gave an example of Barack Obama, the United States President, who as a teenager smoked marijuana, which raised questions now as to whether he had stopped or was still smoking even if  he was leader on a powerful country.

The point Mare was making was once content was made public it stayed and had the potential to build or destroy one's reputation.

 

What the law says 

Katsande said leakage of her private moment should be a criminal offense because "what takes place within the confines of private discussions and places is exposed publicly without expressed consent or permission."

Individuals like Katsande can take take the legal route to stop the release of such material or sue for damages if released without authorisation.

City lawyer, Matshobana Ncube, said a wronged individual can take up the case legally because the country had laws which protected one's privacy.

He said the Access to Information and Protection Act stated people had the right to their privacy and protect their acts carried out behind closed doors.

"No one has the right or even the state to produce such information of anything carried out in secrecy. Even the constitution attests to that. A wronged person can sue for damages or claim damages if harmful information was released without their permission because it can harm their reputation publicly," he said.

Chapter Four of the constitution speaks on the Declaration of Rights for individuals where right to privacy falls under.

 

Gender perspective

In the past, women who have partaken in the private acts, have come out more scarred than their male counterparts when content is released.

It is a possibility Katsande's "sex tape" might be blown out of proportion because she is a woman and a socialite.

This shows women always emerge victims of such acts while their male counterparts are praised of exercising  a masculine act.

Some gender activists have come out in Katsande's defense saying it is sad the woman will be attacked for her free participation.

Genderlinks Media Facilitator for Zimbabwe, Thabani Mpofu, said when it came to sex, an act that involved two people, only the women was fingered, called names but the man was ignored.

"Especially the media will focus more on the woman but why are men ignored. Sexual intercourse involves two people. This is the problem of society when it comes to sexual intercourse gone wrong, the woman is at the receiving end," he said.

Still, some gender activists have refrained from commenting, saying by doing so they would be moralising and glorifying her when it could be a publicity stunt by Kastande since she was a socialite.

They pointed out gender activism had no case in such events when the person behind wanted more fame and "facebook likes."

"What are  we fighting for here? What are we amplifying? Maybe she is competing with Pokello and wants to contest in Big Brother? What if she is the one behind the leakage. This calls for a thorough investigation first," said one activist.

Another said she was conflicted because she did not want to send the wrong message to young girls that it was okay for them to take graphic pictures of themselves and beg for mercy when they were leaked.
