{UAH} Petition to Remove Unlawful Positions 2
Several members have asked me what would happen in case the Executives ignore the petition. I had provided the answer last week but I'll provide it again.
We will request the Executives to call a special meeting to address the matter. If they ignore that request, the law provides that 10% of the members can request the court to authorize one or more members to call (and chair) a special members' meeting. At that meeting, the members can reach a binding decision.
To that effect, I am going to modify the petition to include a call for a special meeting to address the matters in the petition. All those members that have already signed and sent me the petition will have to sign again...sorry folks!

Petition to Remove Unlawful Positions
i-the Executive dismiss the Director of Communication, Director of Finance, Director of Development;
ii-the Executive disband the entire Council, the Board of Trustees and the Election Commission;
iii-the Executive declare that the Election Commission shall be composed of members appointed by their respective local chapters;
iv-Timothy Gaburungyi shall cease controlling the website and mailing list of the association;
v-Jude Sempungu shall assume all powers of the treasurer, including full custody of all funds of the association and compiling the voters' register and members register.
REASONS for removing the Council, Board of Trustees and Election Commission: the Directorships, Council, Board of Trustees and Election Commission were created under the 2010 constitution which is unlawful. The 2010 constitution was not passed after the statutory notice period (M.G.L. Chapter 180, s. 17); the statutory requirement for a 2/3 majority vote was not met (M.G.L. Chapter 180, s.7) and a petition was not sent to the state to explain why that requirement was not met (M.G.L. Chapter 180, s.7A); the state has not approved the 2010 constitution (M.G.L. Chapter 180, s. 17); and the 2010 constitution has several illegal provisions like not allowing members a vote to approve Board members (M.G.L. Chapter 180, s. 17), not allowing members to nominate candidates for the Board of Trustees (M.G.L. Chapter 180, s. 17) and Article 3.6 of UNAA's constitution allows the Council (management) to expel members without a general membership vote (M.G.L. Chapter 180, s. 18),etc.

REASONS for removing Timothy Gaburungyi from the association's website and mailing list are that he has blocked several members from the list without explanation and because this is an election year, Timothy Gaburungyi has been blocking messages that are unfavorable to the current Executives.
REASONS for restoring the treasurer's powers and duties is that Jude was directly elected by voters. The power to remove remains with the voters.
