Nine youth sent to High Court for trial over terrorism charges

Buganda Road Court Grade One Magistrate, Ms Joan Aciro committed the suspects to High Court on grounds that her court does not have the powers to try capital offences.
The suspects who include ; Abudalah Kisembo, Adan Luwooza, Hamisi Mugoya, Hamuza Lyavaala, Ramathan Musene, Hussein Ndugwa, Faizo Wata, Hamza Egiyoti, and Hamis Takubyaku are also facing charges of providing financial assistance for terrorism. Their committal was prompted by an indictment letter from the Director of Public Prosecution (DPP), Mike Chibita, which indicated that investigations into the case were complete.
Prosecution alleges that between 2000 and 2014 at different places in Uganda, Kenya and the DR-Congo, the suspects belonged to ADF which is a terrorist organisation under the Laws of Uganda.
The lead suspects Kisembo and Luwooza are also seperately charged with providing financial assistance to members of ADF, when they had reasonable cause to suspect that the said assistance was going to be used in terrorism activities.
In the indictment before court, the state intends to adduce evidence to show that the duo were former ADF rebels who defected and were both subsequently granted Amnesty in 2003 and 2008 respectively.
"The duo started mobilizing people for ADF activities with an aim of taking recruits to ADF camps in DRC for training .That the enlistment gained momentum in the months of May, June and July 2014 when Kisembo who was a gold buyer in Mubende lured Musene to mobilize their co-accused who are all gold miners to move to DRC to train in ADF activities," reads part of the indictment.
The indictment further reveals: "The youths were to be taken under the pretext of mining gold in Mambasa in DRC under better terms and wages. Evidence will show that recruits were introduced to Mr Tonny Chonga as their new boss in gold mines in DR-Congo who convinced them to transport themselves up to the boarder after which he would take care of the rest of their maintenance when they cross over."
Meanwhile, Four brothers; Sheikh Ssiraje Kawooya, Sheikh Rashid Jjingo, Sheikh Abdu Salam Ssekayanja, Sheikh Twaha Ssekito who are part of the 18people arrested, charged and committed to High Court for trial over the murder of Muslim clerics in Kampala, have applied for bail saying it is their constitutional right to be released pending trial.
Through Sserwadda and Company Advocates, Kawooya, Jjingo and Twaha filed the application before the High court's International Crimes Division saying they have never committed the alleged offence but their only crime was to go and see their brother Sheikh Ssekayanja who had been arrested by police.
Sheikh Ssekayanja had been arrested from plot 11 Luwum Street in Kampala on terrorism related charges and taken to his home where a police search yieleded nothing.
The four were jointly charged with Tabliq Muslim sect Amir (leader), Sheikh Muhamad Yunus Kamoga over terrorism, murder, crimes against humanity and attempted murder.
Australian based cardiologist Dr Aggrey Kiyingi is also linked to the said charges by the state.
