Tobiko shuts Orengo graft probe, says no evidence
Director of Public Prosecution Keriako Tobiko has ordered a case against Siaya Senator James Orengo shut for lack of substantial evidence.
"Ethics and Anti Corruption Commission recommendation to close file for lack of evidence accepted, file ordered closed," Keriako Tobiko said in a joint statement on Friday.
Orengo was accused of receiving a Sh5 million bribe, for the sale of a plot in Nairobi's Westlands area to former Nairobi mayor George Aladwa, which the former Lands Minister insisted was his land, inherited from his father in 1965.
Tobiko also deferred a decision to charge Machakos Governor Mutua, pending court petition.
"Considering to prefer any criminal charges against the governor in relation to the tender question pending the hearing of constitute a decision whether or not to charge aim be deferred to await the outcome of the petition," said Tobiko.
He is accused of irregularly purchasing of 15 Subaru outback motor vehicles and one Toyota Cruiser for Machakos County Executive members through single sourcing.
However, Tobiko said action against Turkana county Governor Josephat Nanok and two other acused persons be taken immediately.
Nanok has been accused of irregular payment of Sh14million to a contractor by Turkana County Government for construction of bridge, when no work was done.
The DPP also directed that administrative action be taken against Wycliffe Odiwuor Otieno and Nazareen Amondi Opiyo for failing to comply with procurement procedures for furniture and equipment for the residence of Kisumu County Assembly, valued at Sh3.5million.
