PRIVATE PROSECUTION IS THE VOICE OF THE VOICELESS

 

The Police and the Directorate of Public Prosecutions (DPP) are constitutionally charged with investigating and prosecuting of criminal offenses respectively.  After he privatized the two institutions, Uganda's Military dictator Museveni all along knew that trough his agents he could commit any crime against Ugandans and get away with it.  However, he was mindful of Article 120 (3) (c) of the constitution that provides for private prosecutions in matters of human rights violations.  Section 11 (1) (c) of the Prohibition and prevention of Torture Act of 2012 also allows a victim of torture or any other person to bring a complaint of torture before a Magistrate. 

 
It is against this background that early this month, a group of private legal practitioners came together and commenced private criminal proceedings against the IGP jointly with a few other senior police officers for torture.  The regime panicked and  resorted to outright blackmail, intimidation and bribery.  From refusing to be served with Criminal Summons to organizing and  facilitating goons to attack courts of law, the regime bought off the 3 complainant victims who had initially swore affidavits in support of their grievances before they later retracted their statements by claiming to have been bribed by opposition activists to implicate the police. 
As if that was not enough, the regime through the DPP took over the prosecution of the matter from the private Lawyers.  It is on  record that all such private prosecutions that the DPP taken over in the past don't succeed.  Now, the Kavuma Court alias Constitutional Court has issued an order staying the same proceedings in the lower court until the constitutional petition in respect of the same case is disposed off. 

All the peace loving Ugandans should rally behind the efforts of these patriotic Ugandans who have volunteered to pursue criminal justice through private prosecution.  The option of private prosecution is coming to light when citizens are at the brink of giving up on Uganda's criminal justice system.  Currently, its the regime through the police and the DPP who decides on who to prosecute and who to shield from prosecution.  

 
The effect has been for the chosen few security officers and other regime cohorts to act with impunity in violating the human  rights of Ugandans.  Therefore, Ugandans  should dig up all the human rights  violations that have been swept under the carpet and present them before court in form of private prosecutions.  How many cases and for how long will the DPP take over such private criminal proceedings with the aim of frustrating justice.
