- Uhuru has welcomed NASA's move to go to court and one of his lawyers says he will pick suit papers from the Opposition's offices

The Independent Electoral and Boundaries Commission (IEBC) says it is yet to receive suit papers from NASA.

NASA led by its presidential candidate Raila Odinga has filed a petition at the Supreme Court challenging President Uhuru Kenyatta's victory and IEBC is one of the respondents.

But in a quick rejoinder, the coalition has dismissed IEBC's claims as "mischievous".

In its petition, the coalition has named IEBC, its chairman Wafula Chebukati and Uhuru as the first, second and third respondents respectively.

But IEBC in a Tweet on Sunday August 20 said it is yet to be served with the presidential petition since the commission was taken to court by NASA on Friday August 18.

The electoral body added that attempts to get the suit papers from the coalition have been futile.

"NASA is yet to serve us with the petition. Attempts to collect it from their lawyers on record proved futile as their offices were closed," said the commission.

But one of NASA lawyers Paul Mwangi dismissed the claims adding all parties to the suit had been served.

"All parties to the Presidential Election Petition have been served and have their documents. Ignore all mischievous claims," he said.

In another tweet, Mwangi said Uhuru's lawyer Fred Ngatia has requested to get the suit papers from NASA offices and that he had sent an assistant to collect them

The Supreme Court rules and regulations on a presidential petition provides two days for parties to be served by the petitioner.

The rules also direct that the petitioners in this case Raila and his running mate Kalonzo Musyoka are supposed to have served the three respondents electronically, six hours after filing the petition at the Supreme Court.

Within two days of filing the petition, NASA is also expected to serve the respondents through a newspaper which has a national circulation.

The coalition on Sunday August 20 placed an advert in one of the local dailies alerting the IEBC as well as Uhuru about the suit.
