MORE LESSONS FROM THE LAND PROBE: "WHO IS AN ILLITERATE":
Over the past year, the Commission of Inquiry into land matters has been carrying out public hearings in which a number of people have been called to testify.
There are some people appearing before the land probe who know how to read and write i.e are literate but were shown documents and claimed they did not know the meaning or understand the language in the documents e.g land sale agreements.
Under Uganda's laws, such a person can claim to be an Illiterate. However, the legal definition of an illiterate is different from the "normal" English definition.
WHAT DOES THE LAW SAY:
There is a law in Uganda called the ILLITERATES PROTECTION ACT. This law protects people who are considered Illiterate.
WHAT IS THE LEGAL DEFINITION OF AN ILLITERATE:
It defines an illiterate, in relation to any document as a person who is unable to read and understand the script or language in which the document is written or printed.
For example, if one signs a document written in Arabic, and yet that person only understands English, then such a person can be considered an illiterate under this law.
What this means is that if a person proves that he/ she was unable to read or understand contents of the document, then such a document might be declared invalid.
LESSONS:
1. When signing a document with a person, make sure they read and properly understand the contents.
2. In addition, it is advisable to have additional documents on the main document e.g a declaration saying the person has read and understood, or consulted someone who understands the document before signing it.
3. If a person is illiterate, it is always good to have the document translated for that person by a person who is literate and have both of them sign the said document. This might avoid a lot of confusion in future.
