{UAH} A WILL CAN BE OBJECTED TOO. WHY?

A WILL CAN BE OBJECTED TOO. WHY?

If someone feels unfairly treated by the testator, they may object formally to court. Another step in will implementation.
Common grounds of challenging a will include: that the testator remarried and never updated the will, the will was made by a minor, the testator was insane or senile thus did not understand what they were doing.

Other cases include: the property in the will was destroyed or sold and that the will fails to adequately provide for a spouse or spouses, children and those who depended on the deceased during their lifetime. (Please note…..SPOUSES).

Just to add that marriage revokes a Will even if all the above requirements are met.In otherwords if one makes a Will and later gets married then such will is automatically revoked.

Most people are living as friends and they are calling it marriage yet in such an arrangement, one party can do what she plans and its ok. But we shud also consider that a pre-marriage agreement can be made regarding property ownership....which can enable one party to retain his/her property acquired be4 marriage, and if so then a will made may not be revoked. By marriage I mean legal marriage( eg civil marriage at URSB, customary marriage (kwanjula( not kukyala) kuhingira etc), Islamic marriage or church marriage.

Be cautious with the lawyers because some ain't professional enough, they change wills or cut deals with relatives and betray u or beneficiaries-That is if u choose again to have lawyers.

Some slight addition, the legal age for one to make a will is 21yrs. The succession Act says 21 but the constitution which is the supreme law in the land considers any person above 17 an adult and of age and thus capable to enter into any contract including writing a will

best wishes
