Your #LEGAL #DICTIONARY
1. Amicus Curie: This is a friend of court. If you remember during the Presidential Election Petition of 2016, some academicians from Makerere University were "Amicus Curie".
2. Carnal Knowledge: In law, we don't say "so and so played sex", we use "carnal knowledge" instead e.g they had carnal knowledge. Basically, carnal knowledge means "sexual intercourse". Some carnal knowledge is unlawful e.g carnal knowledge with an animal or carnal knowledge with a person below the age of 18 years.
3. In flagrante delicto: Caught in the act i.e redhanded. E.g. He was caught in flagrante delicto stealing maize from the garden.
4. Pro se – A person who represents himself in court alone without the help of the lawyer.
5. Kowtow: To act in an excessively subservient and obedient way. E.g. A certain district LC official was seen kneeling before a government official, now in this case, people can ask, "Did the district official have to kowtow the government official?"
6. Ex Parte (not expert or expatriate): Basically, this means one sided only. For example, the judgement was Exparte which means only one side was represented.
7. Garnishee order: A legal procedure by which a creditor (one who is owed money) can collect what a debtor owes by reaching the debtor's property when it is in the hands of someone other than the debtor. In Uganda for example, if a father is told to pay child support but fails, then the mother of the children can go to Court, and get this order, and go to the bank and forcefully deduct money from the father's bank account.
8. Habeas Corpus: A court order used to bring a person physically before a court in order to test the legality of the person's detention. For example, if someone is arrested and taken to an unknown place, then the relatives of that person can go to court and get this order which compels government to bring that person to Court.
9. Indigent: Someone who cannot afford to pay certain fees required by the court. In Uganda, indigents are entitled to legal aid.
10. Plea Bargain: The agreement a defendant makes with the prosecutor to avoid a trial. Usually involves pleading guilty to lesser charges in exchange for a lighter sentence.
11. Ab initio: This means from the beginning. E.g When a person signs a contract for an illegal item e.g contract to buy and sell children, such a contract is void ab initio i.e It is invalid from the beginning.
12. In camera: In Uganda, trials are carried out in open court i.e the ones where everyone interested can attend. However, some cases are sensitive that Court decides to have the case tried in Chamber. In Chamber basically means in private, or in secret and this usually is in the office of the Judge/ Magistrate called a Chamber. That's what we term as a trial in camera(private)
13. Quid pro quo: This means "this for that" i.e you scratch my back, I scratch yours.
