CAN A DUAL CITIZEN OWN LAND PERMANENTLY IN UGANDA?
Under the laws of Uganda, a non-citizen is not allowed to own land permanently. They can only own land for a specific period of time under a land tenure called the Leasehold land tenure system. A Leasehold form of land tenure is where a property owner like the Uganda Land Commission, the Kampala District Land Board or even a private individual grants ownership and use of land for a specific time period. This can be for 49 or for years 99 years but there is always a condition that that person pays a rental fee for the land that they are owning for that period of time.
However, an interesting scenario arises when a person has dual citizenship. Because the law only permits permanent ownership of land to Ugandan citizens and forbids permanent land ownership by non-citizens. The question is therefore is, how about a person who has both Ugandan citizenship and the citizenship of another country? Can such a person own land permanently?
Well, first of all, the law is silent on whether a dual citizen can own land or not in Uganda. Nonetheless, the actual question that one should ask is whether a dual citizen is a citizen of Uganda. The answer is a strong YES! A dual citizen is still a citizen of Uganda.
Therefore, a dual citizen of Uganda can buy and own land permanently in Uganda provided that he or she proves with the proper documentation that he or she is indeed a Ugandan citizen. Such a person enjoys the privileges that any other Ugandan enjoys with regard to land ownership.
