DO I HAVE A DUTY TO RESCUE MY ENEMY WHEN THIEVES ARE TRYING TO KILL HIM?
Stop me if you have heard this one; 'If I saw you being eaten by lion, I would call for help on my way home" Imagine if your enemy is being beaten by thieves. What would your reaction be? (Don't pretend that you are very holy) Some of us would dance and celebrate or like the guy above we just talk about that guy being beaten by a thief later.
Anyway, however much this may only just land you in hell, did you know there is no legal duty to rescue your enemy? Yes! The law believes that unless you are in a special relationship to that person it cannot just impose a duty on you to always be on the lookout to save everyone. You are not Superman! or Super Girl… after all.
WHEN DOES THE LAW PUT THIS DUTY ON ME?
As we said, liability (this means fault) for failure to act will arise when the law has recognized that you have a legal duty, for example,
1. Between parents and child.
2. If you are the one creating a harmful situation, then my friend you have to rescue the person.
3. The person is under a contractual duty to save, for example, lifeguards at a swimming pool who is on duty.
4. The person has voluntarily undertaken the care of another; or
5. If the law puts a duty on you such as a parent under our children Act, do not let your child starve.
If you fear hell or just have a good heart, please help out a buddy with this in mind. If you don't have either of these, the ancestors will still come for you so please yell for help if your enemy is being robbed, it will not bring you problems.
