{UAH} HAVE YOU EVER HEARD OF AN INCHOATE OFFENCE?

HAVE YOU EVER HEARD OF AN INCHOATE OFFENCE?

This strange word "inchoate" is something you can think of as meaning "incomplete". So an inchoate offence is basically where a person tries to commit a crime but fails but when even trying itself is a crime. For example as a child if you were caught trying to steal sugar, even if you did not succeed you would still be caned for the attempt.

What is important in that case, is you INTENDED and WANTED and TRIED to steal that sugar- those things together mean you have already done something wrong.

HOW IS IT POSSIBLE TO HAVE COMMITTED AN OFFENCE WHEN I FAILED TO COMMIT ONE?

It may sound confusing until you put it into context. For example if you try to kill a person, you run at them with a panga but people stop before you cut them- you know for sure that you will be arrested by police and charged with "attempted murder". This is an inchoate offence,

KNOWING IF YOU ARE THE VICTIM OF AN INCHOATE OFFENCE

It is important for those of us who don't make it a habit of being criminals to know WHEN we are victims of a crime.

It may be easy for you to think that just because someone threw a panga at you and missed it is not a crime and you can't report it to Police but we urge that you look at it in a different way in order to decide whether to report it:

1. Did the person intend on causing you any harm.
2. Does that person have any history of acting in that way with you (be it violent or threatening)?
3. Is it possible that it may happen again?

If the answer to all those questions is yes, then it is important that you think about reporting it- even if no harm has come to you yet! Even if the danger is coming from the love of your life.
