WHAT HAPPENS IF I CARRY SOMEONE'S BABY AND THEN I DROP THEM ACCIDENTALLY?
Mr. ABC is known as a very kind person in his town. He helps old ladies cross the road, he helps pregnant women carry heavy things and on this particular day he offered to carry Mama Tendo's baby. While carrying Tendo, he tripped and Tendo fell on a sack of potatoes. Even though Tendo did not get badly hurt, he was still hurt. Mama Tendo is in tears. She wants Mr. ABC to pay for all the hospital bills plus also 'pocket money' to pay for Tendo's milk. Mr. ABC believes that he did everything out of the goodness of his heart and so does not see why he should pay.
WHAT DOES THE LAW SAY ABOUT THIS?
Under the law, it would be said that ABC did not act with reasonable care hence him dropping Mama Tendo's child.
Lack of Reasonable care means failure to exercise appropriate care when doing something or in a particular circumstance.
It can be said that he was negligent because he caused harm to Baby Tendo by failing to act. This failure can be seen as a form of carelessness. The law emphasizes that people should exercise reasonable care in their actions, by taking into account of the potential harm that they might cause to other people or their things.
WHAT SHOULD MAMA TENDO DO?
Someone who suffers loss or harm or gets hurt caused by another person may be able to sue for damages to compensate for the harm or hurt caused to them. Such loss may include physical injury, harm to one's property or even economic loss.
WHAT WILL THE COURTS CONSIDER WHEN MAKING A DECISION AFTER MR. ABC HAS BEEN SUED
The courts will consider the following:
i. Whether the person had a duty to carry the child,
ii. Whether the person (ABC) did not fulfill that duty
iii. Proximate cause (basically whether the fall caused the harm to the child and to what extent)
iv. Damages caused as a result of the negligence
