A freehold title is one made out of land converted from customary holding or leasehold from public land.
Mailo titles are titles curved out from mailo land that was given to Chiefs and Kings in Buganda,Bunyoro,Toro and Ankole.
Freehold titles are common in areas outside Buganda.....and if found in Buganda that land was formally public land or crown land. Freehold property can be defined as any estate which is "free from hold" of any entity besides the owner. Hence, the owner of such an estate enjoys free ownership for perpetuity and can use the land for any purposes however in accordance with the local regulations.
The difference is the similarity ,they both have absolute ownership .just that one is called free based on its back ground and the mailo based on its back ground .there back grounds are different but both have same ownership .and actually if you want you can change your freehold title to mailo here in buganda
Mailo land tenure; This is the most misunderstood tenure in Uganda simply because it creates dual ownership over the same piece of land.Mailo land owners have the same rights as freehold land owners, but they must respect the rights of lawful and bonafide occupants and Kibanja holders to occupy and live on the land. (Section 3 (4) of the Land Act). Buganda Land Board operations are largely based on Mailo land .--
