LET'S LOOK AT THE 2001 AND 2006 ELECTION PETITIONS BY PRESIDENT KIZZA BESIGYE.
Uganda has had Eight Elections in our 59 years of scripted independence, save for the 1962 independence Election that was organised by the departing colonial Government , the rest have been of the same story full of malpractice.
On 12th March, uganda held it's second sham Election under the 1995 constitution , with avoterturn out of 70.3%, all the candidates were independents since political parties were banned at a time.
The sham Election had ,presidential candidates president kizza Besigye of Reform Agenda, Gen. Museveni, Indomitable and consistent chaapa karuhanga, Mr. Kibiringe mayanja, Mr. Aggery Awori.
The most ever violent Election was cheated by Gen. Museveni , and this didn't go well with president kizza Besigye the first runner up per the Ec publications.
On 23rd. March. 2001, president kizza Besigye the petitioner filed the petition that commenced on 27th March 2001 and ended on 13th. April . 2001, At the supreme court at kampala which ended in athree to two decision as it swung in to Gen. Museveni,s favour .
By chief justice Benjamin odoki, Joseph Mulenga and justice Alfred karokore who ruled to uphold the Election.
while justice Arthur oder and justice Wilson TSekooko ruled to annual the Election. The petition was dismissed with an order for each party to bear it's costs.
Among the irregularities tabled by president kizza Besigye,included.
Numbers of polling stations increased on the eve without sufficient notice to candidates, Ec failed to prevent ballot stuffing.
Agents arrested, Gen. Museveni was personally accused of statements that president kizza Besigye was suffering from AIDS, offered Gifts etc.
Gen. Museveni was accused of Organising Groups under the presidential protection unit and kakoza mutale with his notorious kalagala Action plan. That was accused of using violence against our supporters and our president.
More than twenty irregularities were submitted by president kizza Besigye.
On 23rd Feb. 2006 uganda held its first Election under multiparty politics, presidentkizza Besigye who had come back from exile, accused of rape and treason participated in the sham Election under the Forum for Democratic Change
party.
Our victory was overturned in a broad day light , forcing us to enroute to the courts .
In 2006 it was different, president kizza Besigye hired statistician Dr. Jonathan .O. who was to deduce from the widence available and the votes president kizza Besigye could have lost to Gen. Museveni as result of the irregularities.
In 2006 majority of the Fdc leaders had advised president kizza Besigye from going to the kangaroo courts, depending on the 2001 judgement , were the ruling wasn't in their favour amidst tabling affidavits .
President kizza Besigye says, they decided to lodge the petition to expose and resolve the inconsistencies in the judiciary and constitution.
President kizza Besigye led to court to provide supreme court judges with the opportunity to show that they had reflected in 2001 Elections and should be annulled.
In the 2006 petition the three judges were joined by Bart katureebe to uphold the Election, professor George kanyehamba, Mr. Sekooko and the late Order ruled to cancel the Election.
In 2010 , professor George kanyehamba said the two judges that were against the petition have so far changed their minds, and agree that the Election was cheated, thou they will never say it in public for the fear of their lives.
It's on record , Gen. David sejusa has continuously said, president kizza Besigye won the 2006 Election with 70% but it was the military that changed the results to award Gen. Museveni with 58% and president kizza Besigye 37 %. As it was published by the kigundu Ec.
The rulings in both cases were virtualy carbon copies of each other, all the supreme court justices after agreeing that the Election was riddled with various irregularities but which weren't sufficient to cancel the victory.
In 2006 after the ruling , president kizza Besigye complained about the law Governing presidential petitions which he said were the great burden .
In the 2006 petition some districts like kiruhura, pallisa manafwa exceeded the number of voters.
The polling Agent at pallisa school confessed about the irregularities that were practised when it rained and people were told to take shelter in the classrooms, the military appeared and practised all the dirty work to favour Gen.m7. Alot that was submitted in the petition.
After the 2006 petition ruling, president kizza Besigye vowed never to petition to the kangaroo courts ordained by Gen Museveni.
In 2011 after the sham Election , the president came up with walk to work which almost toppled the regime, it's alleged that Gen. Museveni was on the run with his personal jet.
some of his family members had left the country. Walk to work was put on halt on 28th. April. 2011 when the notorious Gilbert Bwana broke the windscreens of the president and sprayed him with dangerous chemical substances.( I had to shed tears on that bad day as I watched the scenes on Ntv)
The president was airlifted to Kenya for treatment. On his return on 22nd May he found when most of the Fdc youth were compromised by the regime with scholarships, Goats and millions from kale kayihura.
In 2016, the president had to swear an oath of allegiance thus forming the peoples Government.
Just like his successor in the 2021 sham elections , Eng. Patrick Amuriat oboi didn't go to the kangaroo courts ordained by Gen Museveni.
Thou as the fdc institution, we helped the sister party Nup with Declaration forms in their petition, since they never had agents in some areas.
PoA says , we are going to the public courts as we champion plan B, were we are fighting to subdue the Gun rule to people rule.
