CAN YOU STILL BE ARRESTED FOR ADULTERY?
So, recently a one J was allegedly caught red-handed in another person's bed. We shall not go into the details of whether it is true or there was a set up but in short, one man was caught in a bed that was not his, and the other man had a spear. Next thing we heard is that the man is currently in a police cell. Which got us wondering why J had been arrested?
WHAT DOES THE LAW SAY?
Well, it is possible that J was arrested for sleeping with another man's wife. In law this is called Adultery. Last we checked; adultery was no longer a criminal offence in Uganda. The Constitutional Court scrapped it from the Penal Code because the adultery law prescribed different penalties and remedies for men and women. According to that law, only married men could accuse others of adultery. In fact, an aggrieved husband was compensated with sh1,200, but an aggrieved wife got nothing if her husband the one caught in adultery.
So, for the 'adulterous' few out there, the law did you a favour. However, it also means that J could not possibly be arrested for adultery. If that is the case, then the police and that husband with a spear are doing something illegal and J can sue them for malicious prosecution. (Arresting someone without reason).
