IS IT WRONG IF I RUN AWAY WITH MY BOYFRIEND?

Namutosi a 19-year-old student recently met Alex a 21-year-old builder and they fell 'head over heels' in love with each. However, Namutosi was staying with her parents who were very strict, and she did not want to spend a single second away from Alex. Alex has suggested that they run away on Valentine's day so that they can be together for the rest of their lives in his late father's house in Bulambuli. However, Namutosi has some doubts since she is in school and fears they may be arrested.

WHAT DOES THE LAW SAY?

Under the law, if both Namutosi and Alex are above the age of 18 years, they are adults who know what is good for them and can therefore make decisions without offending the law. The parents of Namutosi would probably not be happy with Alex or Namutosi but there is no legal remedy they can have against them.

WHAT IF NAMUTOSI WERE BELOW 18 YEARS?

If either Namutosi or Alex were to be below 18 years, it would be a different position. By law, any attempt to take her to any place to have sexual intercourse with her is an offence against Alex and anyone who owns that place. In addition, if Alex would be liable for defilement if he engaged in a sexual act with Namutosi.

This is because all persons below the age of 18 are regarded as children under the law, and all children must remain under the care of their parents or guardians. Since Alex is not Namutosi's parent or guardian and therefore has no responsibility to take care of her. He will also be depriving her of her right to education which is against the law.

However, we would like to encourage all of us to seek the consent of our people before we start our families. Let us not just run away like animals. We need the blessings of our parents or guardians.
