WHO ELECTS OR CHOOSES THE JUDGES, AND DO THE PEOPLE HAVE ANY SAY IN IT?
For those of us who may not know, in Uganda the head of judges (called the Chief Justice) appointed by the president. So, what role do the people of Uganda play in choosing their judges?
By law (Constitution), all the people are represented by their elected representatives (MPs) who make up the Parliament. This means that the people can only have their say through these elected representatives.
HOW DO THE PEOPLE HAVE THEIR SAY?
First, the President chooses (appoints) judges following the advice he receives from the Judicial Service Commission. This means that the Judicial Service Commission advises the president on the person suitable for the appointment.
At this point, the MPs (who are the chosen representatives of the people), must interview this selected person and decide whether to approve him or her. In short, the president on his own cannot appoint a Chief Justice without the intervention of parliament. If the parliament rejects the President's chosen candidate, then the President may have to appoint someone else.
