CAN A BENEFICIARY OF INHERITANCE SELL HIS PROPERTY IMMEDIATELY?
Mulindwa was informed that his uncle who passed away last week left him with a piece of land in Kayunga. Immediately he decided to sell the property to his good friend who was present when he received the news. Money exchanged hands and he told Maule to go and take possession of the land. Mulindwa's relatives 'did not want to know' and rejected Mawule's 'agreement' and denied him access to the property. His pleas fell on deaf ears and the relatives told him to start farming on his piece of paper.
WHAT DOES THE LAW SAY?
No, as a beneficiary of an inheritance, you do not have a right to share that which is not yours. As an owner, the law gives you the right to sell or do with your property as you see fit. You can only give title that you possess. Unfortunately, as a non-owner, you do not yet own this legal title therefore until you get the legal title as an owner, you cannot legally sell that property. You may agree with someone that you will sell to them once you get all rights of an owner. This does not mean you have sold or that the 'buyer' now owns the property.
