DO PRISONERS HAVE A RIGHT TO VOTE?
Are prisoners allowed to vote? It turns out no law or court in Uganda had ever considered this question in Uganda until June 2020.
The simple answer is YES!
The Constitution of Uganda says that all Ugandan citizens have a right to vote and it is the duty of the Electoral Commission to take all necessary steps to ensure that there is provision for them to register and exercise their right to vote.
Remember that you are still a Ugandan whether you are living in Uganda, or you left the country for Kyeyo as long as you have not renounced your citizenship. In the same way, whether you are a prisoner in a Uganda Prison, or you are on remand as an accused person, it does not take away the fact that you are still a Ugandan who has a right to vote.
So this means that even prisoners, accused people on remand and Ugandans living outside of Uganda are still all citizens of Ugandan who are entitled to vote in any election.
That court ordered the EC, to "figure it out" on how to allow all these people to participate in the elections. If the Electoral Commission does not provide for how they can vote, it is infringing their rights as per the Constitution.
