WHAT HAPPENS IF YOU REFUSE/FAIL TO PAY PROPERTY TAX? 

By law, every person who is supposed to pay a tax has a duty to make sure they pay it. This includes owners of rentals and if this is not done, the law empowers the collecting authority like KCCA or URA to collect its 'overdue' taxes. 

In the case of overdue property taxes, the law allows KCCA (and other local authorities) to charge you interest of 2 per cent per month for the time the rent is not paid.  

If you still fail to pay your taxes, the KCCA may do the following to get their arrears.  

RECOVERY BY WARRANTY 

The local council sends you a demand notice and can go to court and get a court order to take their tax from you either by collecting from your back accounts, debtors, or other property (This is called execution). 

RECOVERY BY ACTION 

If after 6 years you have still not paid your tax dues, the local council can come for its taxes (by collecting from your bank accounts, debtors, or other property) from you without needing a court order.  

RECOVERY FROM TENANT AND OCCUPIERS. 

The local council can also choose to go to your tenants or those using your buildings and tell them to pay rent directly to them (the local council) until your tax debt is paid. When this happens, you cannot go to the tenants and demand for the rent since it is used to pay your taxes.
