CAN MY BOSS JUST REDUCE MY SALARY ?
Once upon a lockdown, a certain company decided to deduct 25% off the salaries of its staff. It told them; "Guys, everywhere people's salaries are getting reduced, so this is we have done too. We don't think you need this 25% of your "Salo" so we will keep it but, if you think we are wrong, sign here so we know that you still want your money in full." The staff signed on that kipapula (paper) (because who would just say they want less money?)
Anyway, everyone who signed was told to wait a few days at home as the bosses decided on what to do. And lo and behold, the next thing the staff knew they were being told that they shouldn't come back because they dodged work and they were "bad bad" employees. While we were thinking up this purely fictional story, so we got thinking about salaries. When and how can they be reduced and what happens when I don't want mine deducted.
WHEN CAN YOUR BOSS REDUCE YOUR SALARY?
The employment law in Uganda says no boss/ employer should deduct your salary unless they are doing it to pay government taxes on your behalf like PAYE, Local service tax, and savings like NSSF or if you have allowed them to take off some of your salary for things like a SACCO.
BUT HOW THEN DOES YOUR BOSS KNOW YOU HAVE SAID ITS OK TO DEDUCT THE SALARY?
Simple you are supposed to write to your boss and you say "Boss, please remove 10k from my salary and send it to those in need" If you do this, then your boss can legally remove 10k off salary. However, if your boss comes and tells you that he/she has already decided that you will lose some money, then this is wrong because your salary is a contract term that you agreed with him/her. If your boss fires you for refusing or saying you still want that money then this is what we call unfair termination or wrongful dismissal.
So, when your boss changes your salary it means they have changed the terms of your contract and you are now operating under a new contract. Of course, we are not saying you should not agree with your boss on a deduction. It is your right to also agree to a deduction after you have held a discussion.
WHAT ABOUT DODGING WORK?
If an employee has 'dodged' work, then they are doing bad manners so the law allows the employer to terminate their employment after they have been given a fair hearing to understand why they dodged work. So, our "imaginary" company may have acted illegally in firing its staff without asking them why they did not come to work.
Remember also, if a company has to fire more than 10 staff members in a period less than 3 months, it is supposed to first talk to the Ministry of Gender Labour & Social Development and explain the reasons why and also explain when it intends to fire them. If they just fire their staff then they are acting illegally.
